% 09.04.2018 (1) The petitioner seeks anticipatory bail under Section 438 Cr.P.C. in case FIR No.1076/17 under Sections 392/395/397/427/412 IPC read with Section 25 Arms Act registered at Police Station Vijay Vihar. Status report is on record.
(2) I have heard the learned counsel for the parties and have examined the file. By an order dated 30.01.2018, the petitioner was granted interim protection and was directed to join the investigation as and when required. Undisputedly, the petitioner has since joined the investigation. The petitioner was earlier granted interim bail by the BAIL APPLN. 236/2018
trial court by order dated 03.10.2017.
(3) The involvement of the petitioner emerged only in the disclosure statement of the co-accused.
(4) Considering the facts and circumstances of the case, the petitioner is admitted to anticipatory bail and in the event of his arrest, he be released on bail on his furnishing personal bond in the sum of `40,000/-with one surety in the like amount to the satisfaction of the SHO/Investigating Officer with the condition that he shall join the investigation as and when required.
(5) The bail application stands disposed of.
