The present writ petition has been filed seeking a direction to the respondent no.1/MCD to demolish the unauthorised construction being raised by the private respondents no.3 and 4 at property bearing no.589, Jhankar Gali, Chirag Delhi, New Delhi-110017 (hereinafter 'subject property'). A further direction is sought to stop the ongoing construction at the subject property.

The petitioner resides in the property immediately adjoining the subject property. It is stated that the private respondents no.3 and 4 are raising illegal and unauthorised construction at the subject property without The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Photographs have been attached along with the petition to show the ongoing construction and the damage being caused to the property of the petitioner.

Notice is accepted by the counsel appearing on behalf of the respondents no.1, 3 and 4.

Counsel for the respondent no.1/MCD submits that a show-cause notice dated 29th April, 2026, has been issued in respect of the unauthorised construction in the shape of raising walls and columns at the ground floor. A further work-stop notice has also been issued on 4th May, 2026, to the concerned SHO, Police Station - Malviya Nagar, to ensure that no unauthorised construction takes place.

Both the aforesaid documents have been handed over in Court today and the same are taken on record.

In view of the above, the present writ petition is disposed of while directing the respondent no.1/MCD to take appropriate action in accordance with law.

Till the time the show-cause notice is adjudicated by the respondent no.1/MCD, the respondent no.2/SHO P.S.: Malviya Nagar, shall ensure that no unauthorised construction is carried out in the subject property. 10.
Pending applications stand closed.

In the event the petitioner has any further grievance with regard to unauthorised construction, he is at liberty to take appropriate remedies in accordance with law.
