The accused/applicant seeks regular bail in case FIR No. 320/2021 of Police Station Gokulpuri for offence under Section 302/201/34 IPC. 2.
Broadly speaking, allegation of the prosecution is that the accused/applicant and her husband killed the deceased by squeezing his private parts because he tried to rape the accused/applicant. But the postmortem report does not show any injury on private parts of the deceased. According to post-mortem report, death of the deceased was due to strangulation. According to prosecution, since only the deceased and the accused/applicant and her husband were alone inside the tenanted premises, it is the accused/applicant and her husband, who have to disclose the manner in which the deceased was killed.
