The present writ petition has been filed seeking a direction to the respondent no.1/BSES Rajdhani Power Limited for grant of an electricity connection at the property bearing Plot No.18, Part of Khasra No.30/10, RBlock, Gopal Nagar Extension, Near Green Gold School, Najafgarh, New Delhi-110043 (hereinafter 'subject property'). 2.

Status report has been filed on behalf of the respondent no.1/BSES wherein it is stated that the electricity connection was not granted in favour of the petitioner on account of an ownership dispute between the petitioner and the respondent no.2.

electricity connection to the petitioner. He submits that the petitioner is not the owner of the subject property and therefore, the petitioner is not entitled to grant of electricity connection.

I have heard the counsel for the parties.

At the outset, it may be emphasised that grant of electricity connection would not result in grant of any ownership rights in favour of a person. Merely because the electricity connection is granted in favour of the petitioner, the petitioner cannot claim ownership rights on the said basis. 6.

The Supreme Court, in Crl. Appeal No. 810/2022, titles 'Dilip (Dead) Through LRs. v. Satish & Ors.' held that electricity is a fundamental necessity of a person in possession of a property, regardless of any civil dispute as to the legality of their possession. This Court also, in several orders, has directed electricity connections to be given in the names of the occupants, without prejudice to the rights and contentions to be adjudicated in any civil proceedings.

In view thereof, the petitioner is directed to submit a fresh application for grant of electricity connection along with requisite documents. 8.

Subject to compliance of codal formalities, the respondent no.1/BSES shall grant electricity connection in favour of the petitioner. 9.

It is made clear that the grant of electricity connection by itself would not vest any ownership rights of the subject property in the petitioner. 10.

Accordingly, the present writ petition along with all pending applications stand disposed of.
