O R D E R

The present application has been filed seeking interim bail in FIR No.68/2017 registered under Sections 302/120B/201 IPC at Police Station Defence Colony, Delhi.

Learned counsel for the petitioner submits that the petitioner is in custody since 19.09.2017. He further submits that the petitioner is not involved in any other case and in this regard has referred to the minutes of meeting dated 18.05.2020 of the High Powered Committee. He further submits that the petitioner's son aged about 15 years is suffering from heart ailments and has referred to the medical documents of Sri Krishna Medical College & Hospital, Umanagar, Muzaffarpur in this regard. He further submits that co-accused Aruna has already been released on interim bail and all the material witnesses have already been examined.

Learned counsel for the petitioner further submits that the petitioner's son has been called for further examination and evaluation on Friday, i.e., on 10.07.2020.

A status report has been placed on record. As per the status report, the medical documents of the petitioner's son have been verified to be genuine. 5.

Learned APP for the State submits that the chargesheet has been filed and it is further stated that 17 out of 19 witnesses have already been examined and only the Investigating Officer remains to be examined. It has been verified that the accused is not found involved in any other case except the present one and a telephonic verification from SHO P.S. Sakra was also obtained. He is not found involved in any case in the jurisdiction of P.S. Sakra, District Muzaffarpur, Bihar.

In view of the facts and circumstances of the case, the petitioner is admitted to interim bail for a period of four weeks on his furnishing a personal bond in the sum of Rs.50,000/- with one surety of the like amount to the satisfaction of the concerned Jail Superintendent/Duty MM/concerned Court and subject to the following conditions:- (i) The petitioner shall not try to get in touch with the complainant or any other prosecution witness directly or indirectly and shall not make any effort to tamper with the evidence.

(ii) The petitioner shall provide the concerned I.O./SHO, P.S. Defence Colony with his telephone number (Mob. No. 7479989994) which he undertakes to keep operational at

all times and in the event of change of his residential address, shall inform the same to the concerned I.O./SHO as well as to the concerned Court.

(iii) The petitioner shall report telephonically to the I.O. Inspector Josepha (Mob. No. 8750870867) on every Monday and Friday during the period of his release. Additionally, the petitioner will also report to the SHO, P.S. Sakra, on every Monday and Friday during the period of his release.

(iv) The petitioner shall surrender before the concerned Jail Superintendent after the expiry of the period of his release.

With the above directions, the present application stands disposed. 8.

A copy of this order be communicated to the concerned court and the concerned Jail Superintendent as well as the SHO, P.S. Sakra, District Muzaffarpur, Bihar electronically for information and necessary compliance. MANOJ KUMAR OHRI, J JULY 08, 2020 na
