Through the present petition, the Petitioners seek re-fixation of their pay with effect from the date of their promotion as SubInspector/ Executive (SI/Exe) through Limited Departmental Competitive Examination ('LDCE') as per the order dated 04.11.2006 along with consequential benefits with arrears of pay with 9% interest. 2.

In effect, it is the case of the Petitioners that their case is squarely covered by the judgment of a Coordinate Bench of this Court in Harjinder Singh and Ors. v. Union of India & Ors. : W.P.(C) 9256/2020, where it was held that appointment through LDCE constitutes a mode of promotion and not a fresh appointment, and such personnel are entitled to benefit of option under Rule 5 of the CCS (Revised Pay) Rules, 2008. in the case of Insp Exe Manoj Kumar Yadav & Ors. v. Union of India & Ors. : W.P.(C) 4123/2026. It is submitted that a batchmate of the Petitioners has been accorded the sought relief as well. 3.

The learned counsel for the Respondents requests that the Respondents be accorded an opportunity to examine the claim of the Petitioners for passing an appropriate order in accordance with law. 4.

In view of the aforesaid submission, this Court considers it apposite to direct the Respondents to consider the present petition as a representation and to decide the same within a period of twelve weeks. 5.

The present writ petition is disposed of in the aforesaid terms. ANIL KSHETARPAL, J.
