O R D E R

% 10.05.2019 This petition challenges the impugned order dated 14.01.2019 passed by the learned Trial Court. The petitioner is aggrieved of the fact the learned Trial Court has not allowed her to lead further evidence qua the title of the properties.

The petitioner has filed civil suit for partition, declaration, permanent injunction and mandatory injunction in respect of the properties owned by her late father Sh.Raghuveer Singh. The defence taken by the defendants viz the wife of Sh.Raghuveer Singh and her sons is a) the petitioner is not a daughter of late Sh.Raghuveer Singh; b) deceased Raghuveer Singh had left a Will dated 25.03.1997 in favour of his wife - Smt.Ram Bedi, respondent No.1, which has been proved as Ex.PW1/X2; c) the mother viz. defendant No.1 has already disposed of the property in favour of defendants No.2 & 3 and now they are the exclusive owners of the properties: The efforts of the petitioner/plaintiff to prove the title of the

properties would not be required in view of the defence taken by the defendants viz. the properties were actually owned by late Sh.Raghuveer Singh, who had executed a Will in favour of mother/ defendant No.1, who has since further transferred the property. In view of above, there is no illegality in the impugned order dated 14.01.2019. The petition is devoid of any merits, and is accordingly dismissed. The pending application also stands disposed of. No order as to costs.
