The present application has been filed under Section 439 Cr.P.C. on behalf of the petitioner seeking interim bail in FIR No. 18/2014 registered under Sections 21/22/29 of the NDPS Act and Sections 419/468/471/474 IPC at P.S. Special Cell on the ground that the petitioner's wife is unwell and requires to undergo a surgery.

Mr. Girish Chander, learned counsel for the petitioner has referred to the medical documents of Shri Balaji Action Medical Institute, Paschim Vihar, New Delhi - 110063 in respect of the petitioner's wife. Learned counsel further submits that earlier also the petitioner was released on interim bail which concession he has not misused. 3.

A Status Report has been filed. As per the Status Report, a verification was made from Dr. Suneel Kumar of the aforementioned BAIL APPLN. 1555/2020 Page 1 of 2

hospital who stated that the petitioner's wife visited the hospital only once i.e. on 14.05.2020 in OPD and no further comments were given as the patient visited only once. Dr. Suneel Kumar further stated that though the surgery was advised but no date was fixed as the patient wanted to think about the timing of surgery. It has been further mentioned in the Status Report that the petitioner is found involved in 5 other cases of similar nature. It is further stated that the petitioner's family comprises of his children and brother who may look after the petitioner's wife. 4.

At this stage, learned counsel for the petitioner submits that though the petitioner has two children however, his one child, who is around 40 years old, lives separately in Uttrakhand and his second child who lives with his wife is a minor.

Looking into the facts and circumstances of the case and the fact that no date of surgery of the petitioner's wife is fixed, I do not find any reason to admit the petitioner on interim bail.

Bail application is dismissed.

Learned counsel for the petitioner seeks leave to withdrawn the bail application.
