Petition under Articles 226 and 227 of the Constitution of India, 1950 read with Section 482 of the Code of Criminal Procedure, 1973, has been filed on behalf of the Petitioners for quashing of Enforcement Case Investigation Report F.No.ECIR/09/HIU/2017 dated 07.08.2017, arising out of FIR No. 2172017A0009 dated 02.06.2017.

It is submitted that the Closure Report has been filed in the FIR No. 2172017A0009 dated 02.06.2017 under Section 120B read with Section 420 of the Indian Penal Code, 1860 and Section 13(2) read with Section 13(1)(d) of the Prevention of Corruption Act, 1988.

It is submitted that the Closure Report has been filed in the said FIR, which has been accepted by the learned Trial Court and therefore, nothing survives in the present Enforcement Case Investigation Report F.No.ECIR/09/HIU/2017 and the same may be quashed. 4.
Learned ASG confirms that the Closure Report has been accepted by the learned Trial Court and has no objection to the quashing subject to the right of reviving it in case, the Closure Report is set-aside by the Superior Court.

In view of the submissions made, Enforcement Case Investigation Report F.No.ECIR/09/HIU/2017 is quashed subject to the liberty as prayed for.

Criminal Writ Petition is disposed of accordingly. Pending Applications, if any, also stand disposed of.
