1. The hearing was conducted through video conferencing.
2. The petitioner is aggrieved by inaction on part of the respondentSouth Delhi Municipal Corporation (SDMC) apropos unauthorized construction raised in property bearing no. 406, admeasuring 100 sq. yards, Khasra No. 60, 128, 129 & 130 situated at Chattarpur Pahari, Revenue Estate of Village, Chattarpur, Tehsil, Saket, New Delhi-110
074. The learned counsel for the petitioner contends that despite repeated complaints to the respondent-Corporation, no action has been taken apropos the said unauthorised construction. It is another matter though that the petitioner and the private person are illegal occupants of the suit property and have a lis pending by way of suit for possession before the District Court, in which, thus far, the petitioner has not received any favourable orders. Be that as it may, the present complaint is apropos unauthorized construction which falls entirely within the jurisdiction of the Corporation, for which the said Corporation would need to take appropriate measures as per law.
3. The learned Standing Counsel for the respondent-Corporation states, upon instructions, that the property has already been booked and demolishing action has been planned for tomorrow. Action Taken Report shall be filed by the respondent-Corporation, alongwith photographs indicating the status of the suit property before and after the demolition, within a week from today.
4. In view of the above, no further orders are required. The petition stands disposed-off in terms of the above.
5. Should the petitioner have any further grievance, it will be open to him to approach the Court.
