Petitioner impugns order dated 25.07.2019 whereby leave to defend application of the petitioner has been dismissed and an eviction order passed.

Respondent had filed the subject eviction petition seeking eviction of the petitioner on the ground of bonafide necessity under Section 14(1) (e) of the Delhi Rent Control Act, 1958 from Shop in property No.WZ-451, Gali Keli Wali, Nangal Raya, New Delhi. 3.

Learned counsel for the petitioner seeks leave to withdraw the petition. He undertakes that petitioner shall vacate and hand over the peaceful vacant possession of the premises to the respondent before the Executing Court on 02.11.2019. The undertaking is accepted. 4.

In view of the above, petition is dismissed as withdrawn. 5.

It is agreed between the parties that in case the petitioner RC.REV. 242/2019

vacates on 02.11.2019 all claims between the parties would remain settled.
