Applicant seeks interim bail for a period of 45 days in case FIR No. 189/2023 registered at PS Punjabi Bagh for commission of offence under Section 302/34 IPC.

According to learned counsel for applicant, the applicant has a history of metal plates implanted in the left infra-orbital/zygomatic region and one plate was removed on 25.09.2024 i.e. prior to his arrest in the present. The treating doctors have advised removal of the remaining plate after an interval of about six months to prevent infection, nerve damage and other complications.

Admittedly, earlier, the petitioner had filed an application seeking interim bail before the learned Trial Court but such application was dismissed by the learned Trial Court on 07.01.2026.

Thereafter, the applicant had moved this Court and filed an application seeking interim bail on medical ground but the such application was permitted to be withdrawn by this Court on 28.01.2026 with liberty to move application afresh at a later stage, if the condition of the applicant further BAIL APPLN. 1715/2026 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Learned counsel for applicant submits that there is further deterioration which has necessitated the fresh filing of the application. 6.
He, however, in all fairness, admits that after the latest medical report obtained by him from the Jail, the applicant has not moved the learned Trial Court.

In view of the above, the present application is disposed of with the direction to applicant to move fresh application before the learned Trial Court seeking bail on health grounds.

It is expected that the learned Trial Court shall decide the abovesaid application, without being prejudiced by its earlier order dated 07.01.2026. 9.
Application stands disposed of in aforesaid terms. 10.
It is, however, made clear that this Court had not made any observation, either way, with respect to the present medical condition of the applicant.
