This hearing has been done through hybrid mode. 2.
The present petition has been filed under Articles 226 and 227 of the Constitution of India seeking release of the jewellery items being one gold kada and one gold chain weighing 79 grams and 100 grams, respectively, (hereinafter "the detained goods"), which were detained on 15th March, 2024. 3.
The case of the Petitioner is that he was travelling from Bangkok to India by Flight No. SG-84 and arrived at Terminal-3 at Indira Gandhi International Airport, New Delhi on 15th March, 2024. Upon arrival, the Customs officials intercepted the Petitioner and seized the detained goods vide Detention Receipt dated 15th March, 2024. 4.
The grievance of the Petitioner is that no Show Cause Notice, pursuant to the said Detention Receipt, has been issued till date. 5.

case and whether an Order-in-Original has been passed. 6.
Today, Ms. Anushree Narain, ld. SSC has submitted that no Show Cause Notice was issued in this matter.

Accordingly, the detained goods are liable to be released to the Petitioner. Let the same be released within a period of two weeks. 8.
The Petitioner to appear before the concerned officials, so that the detained goods can be appraised and the same can be released subject to the identity of the Petitioner being verified, since no passport details etc. have been annexed in this petition.

The Petitioner may appear through an Authorised Representative, in which case, the detained goods shall be released after receiving a proper email from the Petitioner or some form of communication that the Petitioner has no objection to the same being released to the concerned Authorised Representative.

It is made clear that only 50% of the storage charges shall be collected from the Petitioner.

The petition is disposed of in the above terms. Pending applications, if any, are also disposed of.
