Learned APP for the State informs that the applicant has already been declared a proclaimed offender. In this regard two judgements of Supreme Court are referred to, Lavesh v. NCT of Delhi reported as (2012) 8 SCC 730 and the decision in SLP (Crl.) 7940/2023 titled as Srikant Upadhyay & Ors. v. State of Bihar.

At this stage, learned counsel for the applicant seeks leave to withdraw the present application to file the proceedings in accordance with law. 3.
