O R D E R

This application has been filed under Section 438 of the Code of Criminal Procedure, 1973 (in short 'Cr.P.C.') praying for grant of anticipatory bail in FIR no.70/2024 registered at Police Station: Safdarjung Enclave, for offence under Sections 323/341/308/34 of the Indian Penal Code, 1860 (in short, 'IPC'). 2.

This Court, considering the nature of allegations made against the applicant herein, had by an order dated 09.4.2024 granted interim protection to the applicant from arrest, subject to the condition that the applicant shall join the investigation. 3.

The learned APP hands over a copy of the Status Report which inter alia sates that post the said order and in compliance thereto, the applicant has joined the investigation and at his instance, certain articles have also been recovered.

The Status Report further states that the other co-accused have already been granted bail.

Keeping in view the above circumstances, it is directed that in the event of arrest in FIR no.70/2024, registered at Police Station: Safdarjung Enclave, for offence under Sections 323/341/308/34 of the IPC, the applicant shall be released on bail, subject to the applicant furnishing a personal bond in the sum of Rs.50,000/- with one local surety of the like amount to the satisfaction of the IO/Arresting Officer/SHO concerned, and further subject to the following conditions:

(i) that the Applicant will join the investigation, as and when directed, in writing;

(ii) that the Applicant shall not, directly or indirectly, try to contact/influence the complainant/victim or any other witness(s) or tamper with evidence of the case; (iii) that the Applicant shall furnish his mobile phone/landline number and residential address to the IO/SHO concerned, and in the event of any change of the same, will immediately inform the same to the IO/SHO; and, (iv) that the Applicant shall not indulge in any criminal activity.
