The petitioner is a Trained Graduate Teacher (Physical Education) in respondent No.1 - Adarsh World School ["the School"]. disciplinary proceedings have been commenced against her. 2.

The disciplinary proceedings concern five charges, including submission of a degree of Master of Physical Education which was obtained through fraudulent means, acts of disobedience, disrespectful behaviour, wilful insubordination, negligence of duty, inflating the marks obtained by her in school and university examinations and experience, remaining absent without leave, and making false statements against the School.

By order dated 18.05.2023, this Court recorded that the inquiry proceedings would be deferred. By further order dated 10.10.2023, the Inquiry Officer was directed to resume the disciplinary proceedings, but this was modified on 19.01.2024 to the effect that the final order would be kept in abeyance until the hearing of the present petition. 4.

The proceedings are listed today on certain applications filed by respondent Nos. 1 to 3. However, the writ petition is taken up for hearing with the consent of learned counsel for the parties. 5.

I am informed that, during the pendency of the petition, the inquiry proceedings have concluded, and the matter is now pending for a decision by the Disciplinary Action Committee ["DAC"]. 6.

In the course of hearing, with the consent of learned counsel for the parties, the writ petition is disposed of with the following directions: A. The DAC may take a decision on consideration of the inquiry report and the petitioner's response, within a period of four weeks from today.

under Section 8(2) of the Delhi School Education Act, 1973. In such an eventuality, the DoE will take into account all the facts and circumstances of the case, including the petitioner's allegations against the School, in deciding whether or not to approve the School's decision.

C. The DoE may also call the petitioner and/or the School for any clarification or further information if considered necessary. 7.
