The present petition under Article 227 of the Constitution of India has been filed impugning the order dated 02.04.2024 passed by the learned Principal Judge, Family Court, South District, Saket Court, New Delhi in HMA No. 1044/2022 titled as ―Angellina Arenja vs. Nitij Arenja‖. 4.

Learned counsel for the petitioner submits that the main grievance of the petitioner is that without deciding the review application moved on behalf of the petitioner, the learned Principal Judge, Family Court perhaps is making an endeavour to decide the application under Section 24 of the Hindu Marriage Act, 1955 (―HMA‖), thus, learned Principal Judge, Family Court be directed that till the review application is disposed of, the application under Section 24 of HMA may not be heard. 7.

Impugned order has been perused.

The learned Principal Judge, Family Court has directed the parties to file their respective income affidavits and the matter is listed for arguments on review application on 18.04.2024. Therefore, no further directions are required from this Court.

Under these circumstances, learned counsel for the petitioner submits that he is ready to withdraw the present petition with liberty to move appropriate proceedings as per law in future, if needed. 10.

Permission to withdraw is granted with liberty as prayed for. 11.
