% 19.08.2020 [VIA VIDEO CONFERENCING] 1.
This order is in continuation of the earlier order dated 7th July, 2020. 2.
Though the petitioner has not filed any additional affidavit for which time was sought but the respondents Central Reserve Police Force (CRPF) have filed documents which are on record.
3.
The counsel for the petitioner states that the respondents CRPF have yesterday issued a Signal acknowledging that the seniority of the recruits of the year 2015 and 2016 had been computed from a wrong date and their seniority has now been fixed with reference to the date of declaration of the result of the examination pursuant to which they were recruited, as of the petitioner and impugning which the petitioner has filed this petition. It is further stated by the counsel for the petitioner that the respondents CRPF have informed that seniority of the batches of the year 2011 and 2012 have been correctly computed in accordance with the Rules. W.P.(C) No.3993/2020
4.
The counsel for the petitioner further states that in view of the above, he seeks to withdraw this petition with liberty to approach again if the recruits of the year 2015 and 2016, aggrieved by the action taken yesterday, approach the Court and a fresh cause of action therefrom accrues to the petitioner.
5.
The counsel for the respondents CRPF confirms that the seniority of the batches of the year 2015 and 2016 had earlier been wrongly computed and has now been corrected.
6.
The petition is dismissed as withdrawn with liberty aforesaid. RAJIV SAHAI ENDLAW, J ASHA MENON, J AUGUST 19, 2020 'gsr'..
