This is the second bail application under Section 439 of Code of Criminal Procedure, 19731) seeking grant of interim bail for a period of 30 days in the proceedings arising from FIR No. 78/2023 registered at P.S. Wazirabad under Sections 307/323/34 of the Indian Penal Code, 1860.2 2.

Counsel for the Applicant submits that the Applicant is suffering from various ailments, including lower backache. He submits that this fact was affirmed by the medical report dated 11th October, 2024 sought by the Trial Court, which indicates that the Applicant's treatment is ongoing. He submits that persistent lower back-ache is causing severe damage to the Applicant's backbone.

He further argues that the other co-accused persons have already been granted bail by this Court.

The Court has considered the aforenoted contentions, but remains unpersuaded. The Applicant's contention regarding grant of bail to coaccused persons is not a valid ground for seeking grant of interim bail on medical grounds. Further, in so far as the Applicant's medical condition is concerned, in the opinion of the Court, the same can be looked after by issuing appropriate directions to the Jail Superintendent. 5.

As per the report received from the Jail Superintendent, which was examined by the Trial Court, the treatment given to the Applicant is presently ongoing. Nonetheless, given that the Applicant is still suffering from persistent back-ache, it is directed that the Jail Superintendent shall get him examined from the concerned department at the All India Institute of Medical Sciences, New Delhi, so that in case any specialised intervention is required, the same can be adequately administered to the Applicant. 6.

With the above directions, the present petition is disposed of along with pending application(s).
