A Writ Petition under Article 226 of the Indian Constitution read with Section 528 BNSS has been filed for quashing of the FIR No.149/2019 under Section 3(1)(c)/3(1)(r)/3(1)(s) of the Scheduled Casts and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 on the ground that the Complaint is malicious and it is evident from the record that no castest remarks were made against the Complainant.

indicating malice and an attempt to misuse the provisions of SC/ST Act. Therefore, the quashing of the FIR is sought. 5.

Learned APP appears on advance Notice and submits that the Charges have already been framed in the present case. If at all the appropriate remedy is to challenge the Order on Charge, rather than filing of present Petition for quashing of FIR.

At this stage learned counsel for the Petitioner on instructions seeks permission to withdraw the present Petition.

In view of the statement made, the present Petition is permitted to be withdrawn.

The Petition stands dismissed as withdrawn.
