% 20.07.2020 In compliance of order dated 08.07.2020, the petitioner has surrendered to custody.

Mr. Gaurav Malhotra, learned counsel appearing for the petitioner draws attention to order dated 11.07.2020 to show that the petitioner appeared before the learned Duty MM-01/West on that date offering to surrender; but, as recorded in the order, since no staff was available to take the petitioner to jail, he was directed to appear before the learned Duty M.M. at Tihar Jail.

Mr. Malhotra then refers to order dated 12.07.2020 whereby, upon appearing before the learned Duty MM, Tihar Court Complex, W.P. (CRL.) No. 1034/2020 Page of
New Delhi, the petitioner was taken into custody and was remanded to judicial custody till 26.07.2020.

Since the present petition has been filed under Articles 226/227 of the Constitution and the petitioner has never applied for regular bail before the trial court, learned counsel for the petitioner seeks leave to withdraw the present petition, with liberty to apply for bail before the concerned court.

For the record, the Investigating Officer/S.I. Anuj confirms that the other co-accused in the matter have already been admitted to regular bail.

Accordingly, the present petition is dismissed as withdrawn, with liberty as aforesaid.
