W.P.(CRL.) No. 1039/2020 The petitioner, who is a convict serving life sentence in case FIR No. 180/2012 registered under sections 302/201/364/120B/34 IPC read with sections 25/27 of the Arms Act 1959 at PS : Maurya Enclave, Delhi, seeks extension of emergency parole/parole for a further period of 08 weeks.

Mr. Anurag Jain, learned counsel appearing for the petitioner draws attention to notification dated 16.05.2020 issued by the Director General of Prisons, Tihar, New Delhi whereby inter alia the

petitioner was granted emergency parole by the competent authority for a period of 08 weeks, which expires on 13.07.2020. On the basis of the recommendations made by the High Powered Committee of the Delhi High Court in its various meetings, Mr. Jain states that the petitioner's emergency parole should also be extended. 3.

Issue notice.

Mr. Sanjay Lao, learned Additional Standing Counsel appears for the State on advance copy; and accepts notice. 5.

Mr. Lao points-out that the Home Department of the Government of NCT of Delhi has issued an order on 07.07.2020 in exercise of the powers conferred under Rule 1212A of the Delhi Prisons Rules, 2018, whereby it has been decided that emergency parole granted to convicts on or before 31.07.2020 shall be extended by a further period of 08 weeks. In view of this order, Mr. Lao submits that the petitioner's emergency parole would also stand extended.

In view of submissions made on behalf of the State, Mr. Jain states that nothing further survives in the present petition provided the State applies order dated 07.07.2020 to the petitioner as well. Mr Lao confirms that order dated 07.07.2020 will apply to the petitioner as well.

A copy of order dated 07.07.2020 has been forwarded by Mr. Lao to the court via e-mail. Let a copy of the order be placed on record ; and a copy be also furnished to Mr. Jain, counsel for the petitioner.

In view of above, nothing survives in the present petition ; and the same is accordingly disposed of.
