The present petition raises a grievance as regards alleged unauthorized construction in property bearing No. D-3, near Balaji Dharamshala Gali, main Market, Shakarpur, Delhi-110092 admeasuring 150 sq. yds.

Learned counsel for MCD, appearing on advance notice, submits that the complaint of the petitioner qua the property in question has been examined and it has been found that a sanction plan has already been issued qua the said construction. As such, at this stage, it cannot be said that the ongoing construction is unauthorised.

At this stage, in view of the aforesaid, learned counsel for the petitioner confines himself to seeking that the complaint/ representation made by the petitioner to the MCD dated 13.03.2024 filed as Annexure P-3 to the present petition be duly considered and disposed of by the MCD, by passing a reasoned order after inspecting the property in question.
