This is an enforcement petition seeking execution of the award dated 13.07.2021 (read with the order dated 27.07.2021) upheld by the judgment dated 08.03.2022 in O.M.P.(COMM.) 373/2021. 2.

The judgment dated 08.03.2022 passed in O.M.P.(COMM.) 373/2021 as well as the award dated 13.07.2021 (read with the order dated 27.07.2021) has been set aside by the Hon'ble Division Bench in FAO(OS) (COMM.) 129/2022, vide judgment dated 03.07.2023. 3.

Even though an SLP has been preferred against the judgment passed by the Hon'ble Division Bench, as of today, the said judgment has not been stayed by the Hon'ble Supreme Court.

For the said reasons, the petition is disposed of granting liberty to the decree holder to revive the same as and when the SLP(C) No. 14364/2023 is decided.
