This hearing has been held by video conferencing. 2.
The present application seeking interim bail had been filed by the applicant contending that the father of the applicant is suffering from certain ailments and was admitted to Medi Polyclinic 532/1, Near Bank Colony, Bandh Road, Devli, New Delhi, since 28.06.2020. The daughter of the applicant, aged about 10 years, was also admitted to the same Clinic as she was suffering from bronchitis, fever and difficulty in breathing.

A Status Report dated 14.07.2020 was filed confirming the factum of admission of the father and the daughter of the applicant in the said Clinic and that the mother of the applicant, being the only member in the family and being aged herself, could not adequately look after the ailing father and the daughter of the applicant.

On further direction of this Court, a further Status Report dated 16.07.2020 was filed confirming that the father of the petitioner was suffering from hypertension, Diabetes, enteric fever, and back pain; not being stable, he was referred to the Safdarjung Hospital on 16.07.2020. The daughter of the applicant was also stated to be suffering from Bronchitis, fever and breathing difficulties and since there was no one to take care of them, the father and the daughter of the applicant were referred to Safdarjung Hospital. 5.
The learned counsel for the applicant thereafter submitted that both the father and the daughter of the applicant have tested positive for COVID-19.

In the Status Report supplied today, this factum has also been confirmed. The Status Report further confirms that the father of the applicant is presently admitted in CHC, Kheri Kalan, Sector-84, Faridabad, Haryana, while the daughter is in home quarantine. 7.
As it has been confirmed that apart from an aged mother of the applicant, there is no one else in the family to look after the daughter of the applicant, who is aged about 10 years and is suffering from COVID-19, I deem it proper to release the applicant on an interim bail for a period of three weeks from the date of his release, subject to the following conditions:
(i) the applicant shall report to the SHO/IO on every Monday, during the period of his release;
(ii) the applicant shall not in any manner, contact any of the witnesses to the criminal trial pending against him; (iii) the applicant shall not leave the territory of State of Delhi without
the permission of the SHO/IO;
(iv) the applicant shall also provide his mobile number to the SHO/IO and keep his mobile switched on 24 hours during the period of his release.

The applicant shall furnish a surety bond for an amount of Rs.25,000/- to the satisfaction of the Duty Magistrate/Trial Court. 9.
The application is allowed in the above terms. A copy of this order be communicated to the concerned Jail Superintendent electronically.
