O R D E R

By virtue of the present petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the petitioners seek quashing of the FIR No.483/2025 dated 20.11.2025 registered at PS.: Anand Vihar, Delhi under Sections 115(2)/126(2)/351(3)/3(5) of Bharatiya Nyaya Sanhita, 2023 (BNS) and Section 10 of the Protection of Children from Sexual Offences Act, 2012 (POCSO Act) and all proceedings emanating therefrom, in view of Memorandum of Understanding dated 27.04.2026(MoU) (Annexure C), whereby the petitioners and the respondent no.2 have mutually and amicably resolved their disputes. 2.

that he has no objection to the quashing of the aforesaid FIR. 3.

Father/ authorised representative of the respondent no.2 present in Court, also accepts notice on behalf of the victim and affirms the terms of the aforesaid MoU dated 27.04.2026 and he on behalf of the victim submit that he has no objection to the quashing of the aforesaid FIR. 4.

Upon consideration of the existing facts and the overall events unfolding in their entirety, even though this Court is mindful that the present FIR No.483/2025 dated 20.11.2025 has been registered under Sections 115(2)/126(2)/351(3)/3(5) of the BNS and Section 10 of the POCSO Act, this Court is inclined to quash the present FIR in exercise of its inherent powers under Section 528 of the BNSS, particularly, since the respondent no.2 is willing to bring closure to the present proceedings and has given her affidavit to the aforesaid effect and is thus no longer inclined to support the case of the prosecution as also since it will also be in the interest of the parties and betterment of their future. Even otherwise, the respondent no.2 is a young girl who has a long future ahead of herself. 5.

The petitioner nos. 1 and 3 alongwith the authorised representatives of petitioner nos. 2 and 4 as also the respondent no.2 present in Court, as well as their credentials as on record, have been identified by the Investigating Officer.

The present proceedings are involving the lives and liabilities of young minds who have a long future ahead. More particularly, since the respondent no.2 does not wish to pursue the present matter, she has filed an affidavit to that effect along with the present petition. As such following the law laid down by the Hon'ble Supreme Court in Gian Singh vs. State of Punjab & Anr.: (2012) 10 SCC 303 and Narinder Singh & The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Ors. vs. State of Punjab & Anr.: (2014) 6 SCC 466, since there is nothing left to corroborate and prove the case of the prosecution, continuation of the aforesaid FIR against the petitioners will be an exercise in futility. 7.

Accordingly, the present petition is allowed and FIR No.483/2025 dated 20.11.2025 registered at PS.: Anand Vihar, Delhi under Sections 115(2)/126(2)/351(3)/3(5) of the BNS and Section 10 of the POCSO Act as also all other proceedings emanating therefrom are hereby quashed. 8.

Thus, the present petition, alongwith the pending application, is disposed of in the aforesaid terms.

At this stage, petitioners, willingly, for the sake of humanity, for doing community service towards one and all, submit that they shall jointly install three water coolers (approx. 80 litres of storage each) and all three water coolers, cost whereof shall be equally borne by all the petitioners, shall be installed in the following manners; first on or before 01.06.2026, second on or before 01.07.2026 and third on or before 01.08.2026 at PS: Anand Vihar, Delhi, SAURABH BANERJEE, J MAY 4, 2026/Ab The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
