Present writ petition has been filed seeking directions to the Respondent to grant permission to the Petitioner to conduct peaceful demonstration/dharna from 23rd April, 2024 to 30th April, 2024 at Jantar Mantar, New Delhi.

Learned Counsel for the Petitioner states that the Petitioner herein is the State President of National South Indian River Interlinking Farmers Association.

Learned counsel for the respondent who appears on advance notice states that Model Code of Conduct is in force and as general elections are around the corner the police force in Delhi is 'stressed' and therefore dharnas/demonstrations cannot be allowed for an extended period of time. 4.

At this stage, learned counsel for the petitioner states that the petitioner would be satisfied if it is allowed to conduct peaceful demonstration/dharna on a single day i.e. 24th April, 2024. 5.

Learned counsel for the respondent states that if the petitioner were to file an application to conduct dharna/demonstration on 24th April, 2024, the same shall be considered in accordance with the Standing Order No.L&O/48/2022.

Accordingly, the present petition is disposed of with liberty to the petitioner to file an application with the respondent seeking permission to peacefully demonstrate/ dharna on 24th April, 2024 at Jantar Mantar, New Delhi. In the event of such an application is filed the same shall be decided in accordance with law within two working days.
