This hearing has been held through video-conferencing. 2.
The Petitioner seeks interim bail, on the basis of the minutes of the High Powered Committee dated 18th May, 2020. He has been charged with committing offences under Sections 302/201 of IPC and has been in judicial custody since 27th March, 2018. The ld. Sessions Judge had rejected the Petitioner's application for interim bail, vide order dated 1st June, 2020 on the ground that the Petitioner cannot be allowed to leave the territory of NCT of Delhi.
3.
Notice was issued on 9th July, 2020, when the status report and nominal roll were called for. Thereafter, on 5th August, 2020, the Petitioner was directed to furnish an address in Delhi, where he intends to stay if bail is granted.
4.
Ld. Counsel for the Petitioner submits that the Petitioner cannot give a permanent address of Delhi, as he is a resident of Bihar. Considering the fact By:PRATHIBA M SINGH
that the allegations against the Petitioner are under Section 302 IPC and his only residence is in Nalanda, Bihar, this Court feels that there is a flight risk insofar as Petitioner is concerned.
5.
In view of the above, though the Petitioner has been in custody for more than three years, this Court is not inclined to release him on bail. The remedies of the Petitioner to file a fresh application for bail in future are left open. 6.
The petition is dismissed, with these observations. PRATHIBA M. SINGH, J AUGUST 14, 2020 Rahul/A By:PRATHIBA M SINGH
