The petitioner seeks quashing of FIR No.115/2019 of PS Kishan Garh, New Delhi for offences under Section 186/353/34 IPC and Section 3 of Prevention of Damage to Public Property Act. Broadly speaking, the FIR was registered on complaint of a traffic police official alleging that the petitioner and her friend travelling on a motorcycle without helmet did not stop on being signalled and rather on return at the same spot, when stopped, the petitioner and her friend not just abused the traffic police official but even tore his uniform and broke the traffic challan hand machine. On behalf of petitioner, it is alleged that it is the traffic police official who slapped the petitioner due to which she fell down on road. Prima facie these are issues of trial.

However, the petition is replete with a number of typographical errors, so learned counsel for petitioner seeks permission to withdraw this petition with liberty to file afresh.

The petition is dismissed as withdrawn with liberty as sought but it is made clear that in the fresh petition to be filed, a copy of this order also shall be annexed and mere permission to file afresh does not mean merits in the petition.
