% 04.05.2026 CRL.M.A. 13874/2026 By way of the present application filed under section 5 of the Limitation Act 1963 read with section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023 ('BNSS'), the petitioner seeks condonation of about 23 days' delay in filing the criminal revision petition. 2.

For the reasons stated in the application, which is duly supported by affidavit, the delay in filing the present revision petition is condoned. 3.

The petition is taken on Board.

The application stands disposed-of.

By way of the present petition filed under section 483 of the BNSS, the petitioner impugns order dated 09.12.2025, whereby the petitioner (husband) has been directed to pay interim maintenance at Rs.8,000/- per month to the respondents, being his wife and children. 6.

At the outset, it is noticed that the impugned order is in the nature of an interlocutory order inasmuch as the petition under section 125 of the Code of Criminal Procedure 1973 ('Cr.P.C.'), is pending before CRL.REV.P.(MAT.) 245/2026 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. In view of the above, in light of section 397(2) of the Cr.P.C. this court is not inclined to entertain the present petition. 8.

The petition is accordingly disposed-of as such without making any observations on the merits of the matter; and granting to the petitioner the liberty to raise all his rights and contentions in the proceedings before the learned Family Court, as may be permissible, in accordance with law.
