An Application under Section 439 Cr.P.C has been filed on behalf of the Petitioner/applicant for extension of Interim Bail for a period of three months on serious medical grounds of the Petitioner. 2.

It is submitted in the Application that he was granted Interim Bail on 31.12.2023. He had an injury in his spine and got admitted in Medanata Hospital on 10.01.2024. He was granted Interim Bail which was extended till 18.01.2024. On 16.01.2024 Aadhya Multi Speciality Hospital advised him to undergo medical surgery on 23.01.2024. The surgery was done on 24.01.2024 and he was advised bed rest in the hospital for recovery till discharge. He got discharged on 01.02.2024. Petitioner was further extended on 07.02.2024 till 08.03.2024 which was further extended upto 27.03.2024. It is submitted that the Petitioner has been examined by the Doctors of Aadhya Multi Speciality Hospital and was advised 12 weeks strict bed rest. On 20.03.2024 his Interim Bail again got extended till 18.04.2024 by learned CMM. The Department of Neurosurgery and Neuro-spine Surgery BLK-MAX Super Speciality Hospital has recommended strict bed rest and precaution. On 12.04.2024 the Interim Bail of the Petitioner was again extended till 09.05.2024. The MRI of the Petitioner was done at Star Imaging & Path Lab, whereby his medical condition was found to be deteriorating. BLK Hospital recommended the MRI and also another surgery of his back on 29.04.2024. The Learned CJM again extended the Interim Bail till 15.05.2024. Further details have been given showing that his Interim Bail has been extended from time to time. On account of his alleged medical condition and he is in the Hospital till date.

The further extension of Bail is sought on the ground of continued treatment of the Applicant and his deteriorating health condition. It had been indicated that he was admitted in ICU on 24.04.2025 and has been discharged on 30.04.2025. In the Order dated 23.04.2025 his Interim Bail has already been denied and he was directed to surrender before the Jail Superintendent. However, the learned Counsel for the Petitioner seeks two day's time to surrender since he had been discharged from ICU on 30.04.2025.

Learned AP for State has submitted a detailed Status Report from Fortis Hospital, Shalimar Bagh. It is also submitted that as soon as the Notice from the Court goes, the Hospital had discharged the Petitioner. The Applicant had got discharged from the Hospital on 30.04.2025. On his request, he is directed to surrender before the Jail Superintendent on 04.05.2025.
