The application under Section 482 read with Section 439 of CrPC has been filed on behalf of the petitioner for extension of interim bail for a period of four weeks, granted vide Order dated 09.07.2024 in BA 1268/2024.

It is submitted in the application that the prescription dated 22.07.2024 shows that the jail authorities did not get the MRI of the petitioner done as advised by the Safdarjung Hospital on 18.09.2023. Considering the ailment of schizophrenia and seizure, he may be granted extension of four weeks of interim bail, so as to enable him to get his MRI done.

Learned counsel for the petitioner, during the submissions, states that because MRI is imperative, it is requested that five days extension be given and that thereafter, no further extension shall be sought by the petitioner. 7.

Learned APP for the State has opposed the application. 8.

Considering the nature of the ailment, which would require long term treatment and also considering that the MRI is necessary part of the treatment, interim bail is extended by five days, as per the terms and conditions vide Order dated 09.07.2024, after which no further extension shall be granted. After the expiry of the interim bail, the petitioner shall surrender himself before the Jail Superintendent. 10.

The application is disposed of.
