The present petition has been filed by the Petitioner - Sanjeev Kumar under Article 226 of the Constitution of India inter alia seeking issuance of an appropriate writ quashing the elections notified vide notice dated 22nd March, 2025 issued by Respondent No. 2- Committee of Khalsa College CoOperative Thrift and Credit Society of SGTB Khalsa College, University of Delhi, North Campus (hereinafter, 'election notice'), along with an interim relief for stay on the elections scheduled on 9th April, 2025. In the present petition, the prayer of the Petitioner is for quashing of the election Notice dated 22nd March, 2025 issued by the Respondent No. 2. The prayer is also for appointment of an Administrator and for stay of the election. 5.

The Court notices that on 22nd March, 2025, the Respondent No. 3 - Dr. Ritwick Bhattacharjee appointed himself as the Returning Officer for the said elections and the election notice was issued under the signature of the Respondent No. 3 without authorization from the General Body of Registrar. 6.

Considering that the election is scheduled for tomorrow, the Court is not inclined to interfere. Any disputes, which the Petitioner may wish to raise, the Petitioner shall seek remedies in accordance with law after the election are conducted.

However, in order to ensure that the elections are conducted in a fair manner, the Registrar Co-Operative Societies (hereinafter, 'RCS') may depute a senior official to oversee the elections.

The name of the Election Officer be finalized by today evening and be communicated to ld. Counsel for the Petitioner. 9.

The said official shall be present at the venue of the elections i.e. Seminar hall SGTB Khalsa College, Delhi, tomorrow morning at least by 09:00 AM, as the polling time has been fixed between 10:30 AM to 01:00 PM.

It is further directed that if any of the teachers etc., are held up in class and they are unable to reach the polling station on time, for casting their ballot, the Election Officer appointed by the RCS can consider extending the time by one hour.
