% 11.05.2018 Mr. Chandra, learned counsel for the custodian submits that subsequent to the impugned order and these proceedings, the custodian has now taken cognizance and issued notice to the concerned and effected parties. It appears that the hearing was even conducted yesterday and adjourned for further proceedings. In view of these developments, learned counsel for the appellant requests that the appeal be permitted to be withdrawn granting liberty to the parties to urge all contentions. It is also submitted that the appellant's rights viz-a-viz the contentions to the validity of the execution proceedings
and the grounds urged in that regard may also be kept open. Liberty granted. All rights and contention of the parties are kept reserved. The Executing Court shall proceed to decide the contentions urged by the parties in accordance with law and in accordance with the past pleadings etc.
The appeal is dismissed as withdrawn along with all the pending applications.
All interim orders are accordingly vacated.
