The present petition under Article 226 of the Constitution of India, 1950, seeks the following prayers: - "A. Issue a writ in the nature of Certiorari or direction for quashing and setting aside the impugned order dated 07.04.2026, issued under section 3 B of the Public Premises Act, 1 97 1 by the Estate Officer, Directorate of Estate, whereby the Petitioner was asked to immediately vacate the said premises, i.e, Government Accommodation at 503 D, Tyagraj Nagar, Delhi. B. Pass any other and further order(s) as this Hon'ble Court may deem fit and proper in the facts and circumstances of the present case and in the interest of justice."

Learned counsel for the respondent, who appears on an advance notice, submits that present petition is not maintainable as alternate efficacious remedy in form of an appeal under Section 9 of the Public Premises (Eviction of Unauthorised Occupants) Act, 1971, can be exercised on behalf of the petitioner in accordance with law.

In view of the above, learned counsel for the petitioner seeks leave to withdraw the present petition with liberty to file an appeal in terms of Section 9 of the PP Act before the Court of competent jurisdiction/appropriate forum in accordance with law.

Leave and liberty granted.

The present petition is dismissed as withdrawn and disposed of accordingly.
