This hearing has been done through hybrid mode. 2.

Vide order dated 10th April, 2024, the present suit was dismissed as withdrawn. On the said date, this Court directed as follows: "3. Ld. Counsel for the Plaintiff wishes to withdraw the present suit and file a fresh suit.

4. It is noticed that no Court fee has been paid.

5. Any fresh suit which may be filed shall be separately valued and Court fee shall be paid on the said plaint on its own terms. The present suit is dismissed as withdrawn with liberty as sought.

6. Since the Plaintiff is seeking liberty to file a fresh suit without filing Court fee in the present suit, list this suit on 22nd May, 2024, for considering whether any condition deserves to be imposed for the withdrawal.

7. It is made clear that no summons has been issued in the present suit."

The Court has considered the matter, it is submitted by ld. Sr. Counsel for the Plaintiff that the Plaintiff has purchased Court fee of approximately Rs.15 lakhs for the fresh suit that has to be instituted by the Plaintiff. In view thereof, it is prayed that no conditions may be imposed. 4.

Considering the nature of the matter, it is directed that a sum of Rs. 50,000/- shall be deposited with the Stock Holding Corporation of India, by the Plaintiff. Let the proof be filed on record. 5.

No further orders are called for.
