Heard the learned Counsel for the Parties.

Mr. Chetan Sharma, the learned Senior Counsel appearing for Respondent No. 1 states that no third-party rights shall be created by Respondent No. 1 for a period of 10 days from today. 3.

We record the said statement.

The learned Counsel for the Appellant, accordingly, states that the Appellant may be permitted to institute an appropriate civil suit before a Court of competent civil jurisdiction with appropriate prayers. He further states that in case such a liberty is granted, the Appeal may be dismissed as non-pressed.

Accordingly, while recording the statement made by Mr. Chetan Sharma, learned Senior Counsel on behalf of Respondent No. 1, we permit the Appellant to institute the appropriate civil suit before a Court of competent civil jurisdiction with appropriate prayers. 6.

It is needless to say that the Appellant will be at liberty to make any appropriate application seeking interim relief / injunction / stay, etc.. 7.

If any such suit is instituted, the same shall be decided by the Court concerned in accordance with law and without being influenced by any observation made by us in this Order or in the order passed by the learned Single Judge.

We make it clear that we have recorded the statement made on behalf of Respondent No. 1, only to facilitate filing of the suit by the Appellant and not for any other purpose.

The present Appeal stands disposed of.
