The present suit has been filed for a decree of declaration with regard to a Settlement Agreement dated 27.03.2023 entered into between the parties in the course of mediation under Section 12A of the Commercial Courts Act, 2015.

At the very outset, Ms. Shobhana Takiar, learned counsel for the plaintiff, seeks permission to withdraw the present suit with liberty to agitate such other remedies as the plaintiff may have in accordance with law.

The suit, alongwith pending applications, is dismissed as withdrawn, with liberty as aforesaid.
