HON'BLE MS. JUSTICE MUKTA GUPTA

O R D E R

% 16.07.2020 The hearing has been conducted through Video Conferencing. 1.

By this petition the petitioner seeks parole. Case of the petitioner is that the petitioner had applied for parole to the competent authority on 23rd June, 2020, however no decision thereon had been taken. 2.

A status report has been filed indicating that the petitioner has been convicted for offence punishable under Section 377 IPC and awarded sentence of imprisonment for a period of 3 years. Nominal roll of the petitioner shows that the petitioner has undergone nearly 1 year 2 months imprisonment and has earned nearly 3 months remission. The petitioner is yet to undergo one year and six months of custody. The jail conduct of the petitioner has been found to be unsatisfactory as he has received punishments on 14th July, 2019, 8th November, 2019 and 28th January, 2020. 3.

Considering the sentence and the jail punishments awarded as also W.P. (CRL.) 1048/2020

that no exigency has to be met, at this stage this Court finds no ground to grant parole to the petitioner.
