After some arguments, counsel for the appellant says that she does not wish to press any further the appeal vis-à-vis the impugned judgment and decree dated 16.12.2021, whereby, divorce was granted to the parties by the Family Court based on mutual consent in the exercise of powers of Section 13B(2) of the Hindu Marriage Act, 1955 [in short, "HMA"]. 3.

Ms Jatinder Kaur Marwah, learned counsel who appears on behalf of the appellant, says that the reason that the appellant has come up in appeal is because he is required to pay immediately Rs.15,00,000/- to the respondent. As per the settlement arrived at between the parties and the directions contained in the impugned judgment and decree, Rs.15,00,000/- was to be paid within six (6) months from the date of the settlement. 4.1 Six (6) months have long expired.

Counsel for the appellant says that the appellant would want a little leeway for paying the said amount.

The appeal is closed with a direction that if an application is moved for granting a short accommodation for payment of the said amount, the same shall be considered by the executing Court as per law after giving the respondent an opportunity to be heard.

Pending application shall stand closed.
