O R D E R

% 27.07.2020 Hearing has been conducted through Video Conferencing. This is an application under Section 439 read with Section 482 Cr.PC for grant of interim bail for a period of two months in FIR No. 244/2020 under Sections 392/411/34 IPC, P.S. Kotwali, Delhi on medical ground of the wife of the Applicant.

Learned counsel for the Applicant submits that wife of the Applicant is in advance stage of pregnancy with complications and she has no attendant in the house to take care of her. The family of the Applicant consists of four minor daughters aged 10, 8, 6 and 4 years. Status Report was filed on behalf of the State wherein it was initially stated that Applicant was previously involved in 25 other cases. Mr. Kalia, on 17.07.2020, had brought to the notice of this Court that Applicant has been discharged in all the other cases barring one in respect of FIR No. 489/2016.

On the last date of hearing, when the matter came up before the Court, Nominal Roll reflected that case in connection with FIR No. 112/2020 was

pending. Mr. Kalia had sought an adjournment to take instructions with regard to the pendency of the said FIR.

Mr. Kalia has filed the order of the Trial Court dated 30.06.2020 whereby the Applicant stands discharged in respect of the said FIR. Ms. Meenakshi Dahiya, candidly and fairly submits that at present, other than the present FIR, there is no other case pending against the Applicant.

I have heard learned counsel for the Applicant and the learned Additional Public Prosecutor.

In view of the facts and circumstances of this case, Applicant is admitted to Interim Bail for a period of two months on the medical ground of his wife, the documents of which stand verified. The Applicant will furnish a Personal Bond in the sum of Rs. 20,000/- with surety of a like amount to the satisfaction of the concerned Duty Magistrate. The Bail will be subject to the following conditions:

a. The Applicant will not leave the jurisdiction of NCT of Delhi without prior intimation to the SHO/IO.

b. The Applicant will give his Mobile Number to the concerned IO/SHO and will keep the same operational at all times. He shall also communicate with the concerned SHO/IO telephonically, every Monday and Thursday between 10.00 a.m. and 10.30 a.m. c. The Applicant shall also 'drop-a-pin' on Google Maps so that his location can be traced out by the concerned SHO/IO. d. The Applicant shall surrender on the date of expiry of his interim bail before the concerned Jail Superintendent.

Copy of this order be sent to the concerned Jail Superintendent for information and necessary action.

Application is allowed in the above terms.
