The present application under Section 483 of the BNSS seeks interim bail for a period of 45 days in case FIR no. 45/2018, under Section 376 of the IPC and Section 6 of the POCSO Act, registered at P.S. Subhash Place. 4.

Learned counsel appearing on behalf of the applicant submits that the marriage of the latter's sister is fixed for 14.04.2025. 5.

Issue notice.

The factum of the said marriage has been verified as reflected in the order dated 26.03.2025 passed by the learned Trial Court. The application for interim bail was declined by the learned Trial Court on account of the fact that there have been frequent disputes between the family of the survivor as well as the present applicant. It is noted that the survivor in the present case is the cousin of the present applicant, who was stated to be 8 months old at the date of incident. 9.

Learned counsel appearing on behalf of the applicant at this stage submits that the latter may be allowed to attend the marriage in custody and does not press the application for interim bail. 10.

Accordingly, the concerned Jail Superintendent is directed to send the applicant in judicial custody in accordance with law on 14.04.2025 at the venue i.e., D Block Park, Near SBI Bank, Sakurpur, Anadvas, Delhi-110034 between 01:00 PM to 07:00 PM.

It is also directed that the officials accompanying the applicant would be in plain clothes.

Needless to state that, nothing mentioned hereinabove is an opinion on the merits of the case and any observations made are only for the purpose of the present bail application 15.
