The Petitioner has approached this Court placing reliance on the decision dated 21st November, 2011 in W.P.(C) 4853/2011, titled Hena Dutta v. Bengali Senior Secondary School, seeking re-employment. It is also noted that the present matter constitutes the second round of litigation at the instance of the Petitioner. In the earlier petition, being W.P.(C) 12246/2018, this Court, by order dated 18th January, 2019, directed the Respondent School to reconsider the Petitioner's case. In compliance with the said directions, the Respondent School by the impugned order dated 9th April, 2019 reaffirmed its earlier decision and declined extension to the Petitioner.

In any event, the Petitioner has now crossed the age of superannuation and, therefore, the relief sought in the present petition cannot be granted. Thus, the Court does not consider it necessary to examine the merits of the rival contentions.

It is clarified that this Court has not expressed any opinion on the notifications referred to in the petition.
