The present writ petition has been filed seeking a direction from the respondent/MCD to take action against the unauthorised hotel being run by the private respondents no.4 and 5 at B-13, Khanpur Extension, Near Shiv Shakti Mandir, Khanpur, New Delhi-110062 (hereinafter 'subject premises').

It is stated that the aforesaid hotel is running next to the house of the petitioner. The same is illegal and unauthorised in violation of the bylaws and without any sanction. Furthermore, the private respondents no.4 and 5 have not obtained permission for parking from the concerned authority. to the unauthorised parking, there is heavy traffic in front of the house of the petitioner.

Counsel appearing on behalf of the respondent-MCD on advance notice submits that a show-cause notice has been issued to the hotel on 14th January, 2026. Subsequently, on 1st April, 2026, a closure notice has been issued to the said hotel. She submits on instructions that as on date, no hotel is functioning at the subject premises.

In view thereof, the present writ petition is disposed of while directing the respondent-MCD to ensure that it strictly acts in terms of the closure notice and ensure that no hotel runs at the subject premises. 5.

Liberty is given to the petitioner to initiate appropriate proceedings in law in the event any further grievance survives. 6.

All rights, contentions and legal remedies of the hotel owner stand protected.
