The hearing has been conducted through Video Conferencing. 2.

By this petition, the petitioner seeks extension of interim bail granted to him by the learned Additional Sessions Judge vide order dated 18th May, 2020, which was subsequently extended vide order dated 9th June, 2020 and is to expire today. The petitioner is in custody in case FIR No. 143/2013 under Sections 364-A/342/323/120-B/34 IPC registered at P.S. Rajinder Nagar. Statement of the victim has already been recorded before the learned Trial Court. The petitioner was granted interim bail to look after his wife who is highly obese and suffering from various ailments. 3.

Learned counsel for the petitioner pointed out that the wife of the petitioner tested positive of Covid-19 and thus, she was admitted in the hospital from where she was discharged and again had to be re-admitted. BAIL APPLN. 1701/2020

Thus, this Court called for a status report from the State. 4.

A status report on facts as also verifying these facts has been filed which indicates that the petitioner was granted interim bail by the learned Trial Court on 18th May, 2020, which was further extended vide order dated 9th June, 2020. As per the status report, it has been verified that the wife of the petitioner tested positive of Covid-19 on 7th July, 2020 and was admitted to hospital but on being tested negative on 10th July, 2020, she was discharged. It is stated that the wife of the petitioner was again re-admitted on 12th July, 2020 with the complaint of difficulty in breathing but was discharged on 14th July, 2020 on the request of the members of the family. As regards the son of the petitioner is concerned, though no test report is available affirming whether he is suffering from Covid-19, however, he is under home quarantine.

Considering the fact that the petitioner has been in contact with Covid-19 patient recently, at this stage, this Court does not find it fit to send him back to the jail. Consequently, the interim bail granted to the petitioner vide order dated 18th May, 2020 by the learned ASJ is extended on the same terms and conditions for a further period of four weeks. 6.

Petition is disposed of.
