Petitioners herein seek quashing of FIR No. 43/2022 dated 09.08.2022, registered at Police Station Cyber Police Station, Outer North District for commission of offences under Sections 420 and 120-B IPC, along with all consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties.

According to learned counsel for petitioner, there are only two accused persons and they both have been charge-sheeted for offence under Section 420 read with Section 120-B IPC. They submit that the concerned complainant has already settled the matter with the accused persons and, therefore, it is a fit case where the proceedings should be quashed. 3.

Learned APP for State, however, submits that the active investigation was already underway and now a supplementary charge-sheet has been laid before the learned Trial Court and names of four more accused persons have come to fore and such supplementary charge-sheet is listed for today. He also submits that the charges have yet not been ascertained so it cannot be, emphatically, claimed by the petitioners that the only offence against them is offence under Section 420 IPC read with Section 120-B IPC. 4.

fact that any supplementary charge-sheet has been filed and he, therefore, without prejudice to his rights and contentions, seeks to withdraw the present petition with liberty to file it afresh after going through the entire matter. 5.

Petition stands disposed of as not pressed.
