Mr. Arun Birbal, learned counsel for the respondent accepts notice. The prayer made in this application is not opposed. Accordingly the date of 24.03.2020 is cancelled. Application stands disposed of.

W.P.(C) No.4210/2019 The writ petition is set-down for hearing today itself. The petition is directed against the order dated 08.02.2019 passed by the Central Administrative Tribunal ('Tribunal' for short)

by which O.A. filed by the petitioner herein has been dismissed. Counsel for the respondent, on instructions, submits that the impugned order of the Tribunal may be set-aside and the matter be remanded back to the respondent for a fresh adjudication. Counsel for the petitioner has no objection.

Accordingly with consent of the parties the impugned order dated 08.02.2019 is set-aside.

The matter is remanded back to the respondent for fresh adjudication.

Mr. Birbal submits that respondent is conscious of the fact that petitioner is retiring on 31.01.2020.

He further submits that respondent would examine the matter expeditiously and positively before 31.01.2020.

Petition is disposed of in terms of aforesaid observations. Dasti to the parties, as prayed.
