The allegations against the accused persons are beating the petitioner herein as also his son. The son of the petitioner herein succumbed to his injuries. The petitioner is aggrieved of the fact despite his son was murdered, on 26.05.2020 FIR No.250/2020 was registered only under Sections 323/304/34 IPC, hence he filed this petition to direct the investigating agency to add Section 302 IPC to the FIR.

The learned ASC for the State informs, without prejudice to the merits of allegations, section 302 IPC has since been added to the FIR on 05.07.2020 after consulting higher police officials. 8.

In view of the submissions made by the learned ASC, nothing survives in this petition.
