The petitioners have filed the present petition, inter alia, praying that FIR bearing No. 976/2015 under Sections 498-A/406/34 of the Indian Penal Code, 1860, registered with PS Moti Nagar, be quashed. 2.

The present petition is premised on a settlement dated 24.12.2016 arrived at before the Mediation Centre, Tis Hazari Courts, Delhi. The learned counsel appearing for respondent no.2 states that although the settlement was arrived at, however, the same has not been implemented. 3.

He has drawn the attention of this Court to Clause 4 of the said settlement which records that Smt. Leelawati, who is the owner of the property bearing H. No. F-43-B, Sudershan Park, New Delhi-110015, shall transfer 1/3rd share in the property to her grand child namely Krishan S/o Sh. Sunil Yadav @ Chintu.

The learned counsel appearing for respondent no.2 states that the same has not been done. He also states that the petitioners are not providing the maintenance as promised.

Since there appears to be some controversy with regard to the settlement, this Court does not consider it apposite to entertain the present petition at this stage.

The petition is disposed of with liberty to the petitioners to file afresh after they have resolved all controversies with respondent no. 2. VIBHU BAKHRU, J SEPTEMBER 18, 2019 RK
