This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:- "It is, therefore, most respectfully prayed before this Hon'ble court may please to issue the directions to the respondent No. 1 Central Board of Secondary Education to correct the date of the birth of the petitioner in the record as 11.12.2002". 2.

The facts are that inadvertently the date of birth of the petitioner was mentioned as 21.12.2003 in the school (Kalka Public School) records while getting an admission in Class X. Accordingly, the date of birth of the petitioner in Class 10 marksheet is shown as 21.12.2003. 3.

passport which recorded the correct date of birth of the petitioner as 11.12.2002.

The petitioner has already made an application to the School which has changed the date of birth of the petitioner to 11.12.2002 from 21.12.2003. 5.

Mr. Kumar, learned counsel for the respondent, opposes the petition and draws my attention to Rule 69.2 of the Examination Bye-laws which read as under:

"69.2 Change in Date of Birth No change in the date of birth once recorded in the Board's records shall be made."

He states that the school could not have changed the date of birth of the petitioner and the writ petition needs to be dismissed on this ground. 7.

I have heard learned counsel for the parties. In a similar matter, W.P.(C) 6554/2023 titled Nisha Ray v. CBSE, I had observed as follows:- "11. Even in the judgement of Jigya Yadav (supra), the Hon'ble Supreme Court has stated that there can only be one Date of Birth. The petitioner is and should be entitled to make a correction to make the document consistent with all public documents, namely, Adhaar Card, PAN Card and the Birth Certificate.

15. I am also unable to comprehend the hostile opposition to the present petition. The Central Board of Secondary Education (CBSE) is a custodian of record and is not required to have personal interest in the date of birth of any candidate." In view of the above, the petition is allowed and respondent shall change the date of birth of the petitioner from 21.12.2003 to 11.12.2002. 9.
